Long Beach, teenager reach $500K deal on injuries

18.05.12

LONG BEACH - A City Council committee has signed off on a $500,000 settlement in a lawsuit filed by a teenager who was walking along North Atlantic Boulevard when she was struck by a car and severely injured.

Melissa Hernandez, 19, sued the city in part because the stretch of road involved does not have a sidewalk and narrows to accommodate a bridge over the Los Angeles River.

Hernandez was 16 years old when the incident occurred on Sept. 12, 2008. Her right ankle was severely fractured and she sustained hip, pelvis and head injuries that have resulted in cognitive problems, according to city records.

"I don't think there was any serious dispute that she had very significant injuries," said Deputy City Attorney Monte Machit.

What was disputed, however, was the extent of Hernandez's cognitive difficulties.
